Terms of Use

1. Introduction and Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the websites, subdomains, platforms, and services operated by Forest Workforce Training Institute ("FWTI," "we," "us," or "our"), including programs branded as ForestryWorks® and other initiatives operated by FWTI (collectively, the "Services").

The Services may include, without limitation, informational websites, learning and training platforms, assessments, surveys, forms, job board services, career exploration tools, and other online resources made available by FWTI or through third‑party service providers acting on our behalf.
By accessing or using any part of the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Services.

These Terms apply to all users of the Services, including but not limited to:

  • students and program participants,
  • educators and school representatives,
  • job seekers,
  • employers,
  • partners and workforce organizations, and
  • general website visitors.

If you are accessing or using the Services on behalf of a school, employer, partner organization, or other entity, you represent that you have the authority to bind that entity to these Terms.
We may update these Terms from time to time. Your continued use of the Services after any changes are posted constitutes acceptance of the revised Terms.

2. Eligibility and Authority to Use the Services

2.1 Eligibility

You may use the Services only if you can form a legally binding agreement with FWTI and are using the Services in compliance with these Terms and all applicable laws.

  • General Users. If you are 18 years of age or older, you represent and warrant that you have the legal capacity to agree to these Terms.
  • Minors (Under 18). If you are under 18, you may use the Services only where permitted by applicable law and with appropriate oversight and/or consent from a parent/guardian or authorized school representative, as applicable to the specific program or activity.
  • Children Under 13. The Services are not intended for children under 13, and you may not use the Services or submit Personal Information if you are under 13 unless the activity is expressly facilitated by a school or authorized educational representative in a manner consistent with applicable law and our Privacy Policy.

FWTI may suspend or restrict access to the Services if we reasonably believe a user does not meet the eligibility requirements above.

2.2 Authority to Act on Behalf of an Organization

If you access or use the Services on behalf of a school, school district, employer, workforce agency, partner organization, or any other entity (an "Organization"), you represent and warrant that:

  1. You have authority to bind that Organization to these Terms; and
  2. Your Organization agrees to be responsible for your access and use of the Services.

If you do not have that authority, you may not use the Services on the Organization's behalf.

2.3 Educators and School Representatives – Student Data Authority

If you are a teacher, educator, school staff member, or otherwise acting on behalf of a school or educational institution and you upload, submit, or provide information relating to students, you represent and warrant that:

  • You have all permissions and authority required by your school or institution to provide student information for program participation; and
  • You have obtained all necessary consents or authorizations required by applicable law and your institution's policies.

You acknowledge that FWTI is not a school official or educational institution for purposes of FERPA. By accessing this site, you are responsible for FERPA compliance as well as ensuring that the student information you provide is accurate and shared only as permitted. FWTI is entitled to rely on your representations regarding your authority to provide such information.

2.4 Job Board Eligibility (Job Seekers and Employers)

The job board and employment-related features are intended for individuals and organizations eligible to engage in employment-related activity.

  • Job Seekers represent that the information they provide is accurate and that they are legally eligible to seek employment opportunities.
  • Employers represent that they have the authority to post jobs, recruit applicants, and process applicant information in compliance with applicable employment and privacy laws.

Certain job board features may require users to meet minimum age requirements (for example, as required by law for employment eligibility). FWTI may limit or suspend access to job board features for noncompliance.

2.5 Partner and Administrator Access

If you are granted administrative or elevated access to any portion of the Services (for example, as a workforce partner, education partner, or state partner administrator), you agree to:

  • Access and use data only for authorized FWTI-related program purposes;
  • Maintain confidentiality of information accessed through the Services; and
  • Comply with any additional requirements communicated by FWTI or set forth in separate partner or program agreements.

3. Acceptable Use and Prohibited Conduct

You agree to use the Services only for lawful, authorized purposes and in a manner consistent with these Terms, our Privacy Policy, and applicable laws. You are responsible for all activity conducted through your access to the Services.

3.1 Acceptable Use

You may use the Services solely to:

  • access information about FWTI programs and services,
  • participate in authorized training, education, workforce, or career‑development activities,
  • apply for jobs or post job opportunities where applicable, and
  • otherwise engage with the Services as intended.

3.2 Prohibited Conduct

You agree that you will not, directly or indirectly:

  • Use the Services for any unlawful, fraudulent, deceptive, or harmful purpose.
  • Violate any applicable local, state, federal, or international law or regulation.
  • Attempt to gain unauthorized access to any portion of the Services, user accounts, systems, networks, or data.
  • Interfere with or disrupt the operation, security, or integrity of the Services or any related systems.
  • Circumvent, disable, or interfere with security‑related features or access controls.
  • Scrape, harvest, collect, or extract data from the Services by automated or manual means without authorization.
  • Use the Services to send unsolicited communications, spam, or promotional messages.
  • Impersonate any person or entity, or misrepresent your affiliation, authority, or eligibility to use the Services.
  • Upload, transmit, or distribute viruses, malware, ransomware, spyware, or other malicious code.
  • Upload or submit content that infringes the intellectual property, privacy, or other rights of any person or entity.
  • Use the Services in a manner that exceeds your authorized role or permissions (for example, accessing data outside your assigned program or administrative scope).

3.3 Uploaded Content and User Responsibility

If the Services allow you to upload documents, files, or other content, you are solely responsible for the content you submit. You agree that you will not:

  • Upload files containing sensitive personal information that was not requested or required (such as Social Security numbers, financial account information, or medical data).
  • Upload content that is illegal, harmful, defamatory, or otherwise inappropriate.

FWTI is not responsible for the content you choose to upload or submit and may remove or restrict access to content that violates these Terms.

3.4 Job Board and Employment‑Related Conduct

In connection with job board or employment‑related features, you agree that you will not:

  • Post false, misleading, discriminatory, or unlawful job listings.
  • Use applicant information for purposes unrelated to evaluating candidates or administering legitimate employment opportunities.
  • Harvest, reuse, or redistribute job seeker information without authorization.

FWTI does not verify employers or job postings and is not responsible for employment decisions, communications, or outcomes.

3.5 Instructional Integrity

Educators, instructors, and authorized school representatives administering FWTI programs or assessments are responsible for supervising instruction, maintaining assessment integrity, and complying with applicable school policies and program guidelines. FWTI does not control or supervise the instructional environment and may invalidate assessment results or deny certification where it reasonably determines that program requirements were not followed or the integrity of the assessment process was compromised.

3.6 Consequences of Violations

FWTI reserves the right, in its sole discretion and without prior notice, to:

  • suspend or terminate access to the Services,
  • remove or restrict content, and/or
  • take other appropriate action

If we determine that you have violated these Terms or engaged in conduct that threatens the security, integrity, or proper operation of the Services.

4. User Accounts and Security

4.1 Account Registration

Some portions of the Services may require you to create an account or be provided account access by FWTI or an authorized partner. When you create or are granted an account, you agree to:

  • Provide accurate, current, and complete information as requested;
  • Maintain and promptly update your information to keep it accurate and complete; and
  • Use the account only for authorized purposes consistent with your role and these Terms.

You may not create an account for anyone other than yourself unless you are expressly authorized to do so on behalf of an organization.

4.2 Account Credentials and Responsibility

You are responsible for maintaining the confidentiality of your login credentials, including usernames, passwords, access links, or authentication tokens associated with your account.

You agree to:

  • Not share your account credentials with any other person;
  • Restrict access to your account to authorized users only; and
  • Notify FWTI promptly if you become aware of any unauthorized access, use, or suspected security breach involving your account.

FWTI is not responsible for any loss or damage arising from your failure to safeguard account credentials or from unauthorized access resulting from your actions or omissions.

4.3 Use of Accounts on Behalf of an Organization

If you access the Services through an account provided by a school, employer, partner, or other organization, your access may be subject to additional restrictions imposed by that organization.

You acknowledge and agree that:

  • Your organization may suspend or terminate your access at any time; and
  • FWTI may rely on representations made by the organization regarding your authority and role.

4.4 Third‑Party Platforms and Integrated Services

Some Services are delivered through or integrated with third‑party platforms operated by service providers. Your use of those platforms may be subject to the third party's own terms and privacy policies.

FWTI does not control third‑party authentication systems, account security practices, or platform availability and is not responsible for security incidents or access issues arising from third‑party services.

4.5 Account Suspension or Termination

FWTI reserves the right, in its sole discretion, to suspend, restrict, or terminate your account or access to the Services at any time, with or without notice, if:

  • You violate these Terms;
  • You exceed or misuse your authorized access;
  • Your account poses a security risk; or
  • Continued access may expose FWTI, users, or partners to legal or operational risk.

Termination or suspension of an account does not relieve you of obligations incurred prior to termination.

4.6 Security Measures and No Guarantee of Absolute Security

FWTI uses reasonable administrative, technical, and organizational safeguards designed to protect the security of the Services. However, no system is completely secure.

You acknowledge and agree that:

  • Access to the Services is provided on an "as‑is" basis; and
  • FWTI cannot guarantee absolute security of accounts, systems, or data transmitted through the Services.

5. User‑Generated Content and Upload License

5.1 User‑Generated Content

The Services may allow you to submit, upload, transmit, or otherwise make available content, including but not limited to resumes, job applications, documents, forms, survey responses, messages, training submissions, or other materials ("User‑Generated Content").

You are solely responsible for any User‑Generated Content you submit and for ensuring that such content is accurate, lawful, and appropriate for the purpose for which it is provided.

5.2 Responsibility for Submitted Content

By submitting User‑Generated Content, you represent and warrant that:

  • You have the right and authority to submit the content;
  • The content does not infringe, misappropriate, or otherwise violate the intellectual property rights, privacy rights, or other legal rights of any third party;
  • The content complies with all applicable laws and regulations; and
  • The content does not include sensitive personal information unless such information is expressly requested or required for a specific program or activity.

FWTI is not responsible for the content you choose to submit, including any information you voluntarily include beyond what is requested.

5.3 Uploads Containing Sensitive or Prohibited Information

You agree not to upload or submit User‑Generated Content that contains:

  • Social Security numbers or other government‑issued identifiers;
  • Financial account or payment information;
  • Medical or health information; or
  • Any other sensitive personal information that is not specifically requested.

If you choose to include such information despite these restrictions, you do so at your own risk.

5.4 License to Use User‑Generated Content

By submitting User‑Generated Content through the Services, you grant FWTI a non‑exclusive, royalty‑free, worldwide, revocable license to host, store, reproduce, process, transmit, display, and use such content solely as necessary to:

  • operate and maintain the Services;
  • administer programs, training, surveys, or job board functionality;
  • facilitate communications between users (such as job seekers and employers); and
  • comply with legal or contractual obligations.

This license ends when the User‑Generated Content is deleted or removed from the Services, except to the extent that the content has been shared with third parties (such as employers or partners) or retained as required by law or legitimate business purposes.

5.5 Sharing of User‑Generated Content With Third Parties

You acknowledge that certain User‑Generated Content may be shared with third parties consistent with the Services' functionality, including:

  • Employers receiving job applications or resumes;
  • Partners or administrators supporting program delivery; and
  • Authorized service providers acting on behalf of FWTI.

Once User‑Generated Content is shared with a third party, that third party's use of the content is governed by its own policies and practices, and FWTI does not control how the third party uses or retains the content.

5.6 Removal of User‑Generated Content

You may request removal of certain User‑Generated Content in accordance with our Privacy Policy and data retention practices. However, you acknowledge that:

  • Employers may retain copies of job applications or resumes you submit;
  • Partners may retain program‑related submissions consistent with their obligations; and
  • FWTI may retain copies as required by law, for security, or for legitimate operational purposes.

6. Intellectual Property Rights

6.1 Ownership of FWTI Content

All content made available through the Services, including but not limited to text, graphics, logos, images, videos, training materials, assessments, curricula, software, website design, and other materials (collectively, "FWTI Content"), is owned by or licensed to Forest Workforce Training Institute (FWTI) and is protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in or to the FWTI Content except the limited right to access and use the Services in accordance with these Terms.

6.2 Limited License to Use the Services

Subject to your compliance with these Terms, FWTI grants you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services and FWTI Content solely for personal, educational, workforce‑development, or other authorized non‑commercial purposes related to the Services.

You may not copy, reproduce, modify, distribute, publicly display, perform, transmit, or otherwise exploit any FWTI Content without FWTI's prior written consent, except as expressly permitted by these Terms or applicable law.

6.3 Trademarks

"ForestryWorks®," "Forest Workforce Training Institute," and all related names, logos, slogans, and branding elements are trademarks or service marks of FWTI. You may not use FWTI trademarks without prior written permission, including in a manner that suggests endorsement, affiliation, or sponsorship.

6.4 User‑Generated Content and Third‑Party Rights

As described in Section 5, users may submit User‑Generated Content through the Services. You retain ownership of your User‑Generated Content, subject to the license you grant to FWTI.

You represent and warrant that any User‑Generated Content you submit:

  • Does not infringe, misappropriate, or violate the intellectual property rights of any third party; and
  • May be lawfully used by FWTI as permitted under these Terms.

FWTI does not claim ownership of User‑Generated Content but reserves the right to remove or restrict access to content that violates these Terms or applicable law.

6.5 Prohibited Use of Intellectual Property

You agree that you will not:

  • Use the Services or FWTI Content for any unauthorized commercial purpose;
  • Copy, scrape, or extract content or data from the Services without authorization;
  • Remove or alter copyright, trademark, or proprietary notices;
  • Upload or distribute content you do not have the legal right to share; or
  • Use FWTI Content in a manner that infringes or violates any intellectual property rights.

6.6 Third‑Party Content

The Services may include content owned or licensed by third parties. All such content is the property of its respective owners and is protected by applicable intellectual property laws. Your use of third‑party content is governed by the applicable licenses and terms.

7. Disclaimers and Limitation of Liability

7.1 Services Provided "As Is" and "As Available"

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, FWTI disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non‑infringement, accuracy, availability, or reliability.

FWTI does not warrant that:

  • the Services will be uninterrupted, error‑free, or secure;
  • any information provided through the Services will be accurate, complete, or current; or
  • defects or errors will be corrected.

Your use of the Services is at your own risk.

7.2 No Professional, Legal, or Employment Advice

Information made available through the Services is provided for general informational and educational purposes only and does not constitute legal, professional, or employment advice.

FWTI does not guarantee:

  • training outcomes or certifications;
  • job placement, employment opportunities, or hiring decisions;
  • continued participation in any program; or
  • eligibility for employment or advancement.

You are solely responsible for how you use information obtained through the Services.

7.3 No Verification of Users, Employers, Job Seekers, or Job Postings

FWTI does not independently verify:

  • the identity, qualifications, or legitimacy of employers;
  • the accuracy of job postings;
  • the background, credentials, or conduct of job seekers; or
  • the actions or representations of partners, employers, or other users.

FWTI is not responsible for interactions, communications, decisions, or disputes between users, including between job seekers and employers.

7.4 Third‑Party Services and Content Disclaimer

The Services may include or rely on third‑party platforms, tools, links, or content. FWTI does not control and is not responsible for the availability, security, content, or practices of third‑party services.

Your use of third‑party services is governed by those parties' own terms and privacy policies. FWTI disclaims all liability arising from your use of or reliance on third‑party services.

7.5 Certification Disclaimer

Certifications issued by FWTI indicate that an individual satisfied applicable program requirements at the time of issuance. Certifications do not constitute professional licenses, do not guarantee employment or advancement, and do not represent ongoing competency beyond the date issued. Employers and other third parties are solely responsible for determining whether a certification meets their requirements.

FWTI reserves the right to modify certification validity periods, renewal requirements, or program standards and to suspend or revoke certifications obtained through fraud, misrepresentation, academic dishonesty, or misuse, or where revocation is necessary to protect program integrity.

7.6 Equipment and Hands‑On Training Disclaimer

Certain programs may involve the use of physical equipment, simulators, or training tools provided by FWTI or third-party partners. Such equipment is used under the supervision and control of participating schools or organizations. FWTI does not control the environment in which equipment is used and is not responsible for improper setup, operation, supervision, or any injury, damage, or loss arising from its use.

7.7 Limitation of Liability

To the fullest extent permitted by law, FWTI shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of data, loss of profits, loss of business opportunities, or personal or reputational harm, arising out of or related to your access to or use of the Services.

To the extent liability cannot be excluded, FWTI's total liability for any claim arising out of or relating to the Services shall not exceed the greater of:

  • the amount paid by you to FWTI for the Services in the twelve (12) months preceding the claim, or
  • one hundred dollars ($100).

Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you in full.

8. Indemnification

You agree to defend, indemnify, and hold harmless Forest Workforce Training Institute ("FWTI"), its officers, directors, employees, contractors, partners, and affiliates from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your access to or use of the Services;
  • Your violation of these Terms, the Privacy Policy, or any applicable law or regulation;
  • Any User‑Generated Content you submit, upload, transmit, or make available through the Services, including claims that such content infringes, misappropriates, or violates the intellectual property, privacy, or other rights of any third party;
  • Your misuse of Personal Information or other data obtained through the Services;
  • Your interactions, communications, or disputes with other users, employers, job seekers, partners, or third parties; or
  • Your use of the Services on behalf of an organization without proper authority.

8.1 Employer, Partner, and Organizational Users

If you are an employer, partner, administrator, educator, or other organizational user, you further agree to indemnify FWTI for any claims arising from:

  • Your handling, use, storage, or disclosure of applicant, student, or participant information;
  • Your failure to comply with applicable employment, education, or privacy laws; or
  • Actions taken by your organization or its representatives in connection with the Services.

8.2 Control of Defense

FWTI reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate fully with FWTI in asserting any available defenses.

9. Termination and Suspension

9.1 Termination by You

You may stop using the Services at any time. If you have an account, you may request account deactivation or deletion subject to program requirements, legal obligations, and our data retention practices described in the Privacy Policy.

9.2 Suspension or Termination by FWTI

FWTI may suspend, restrict, or terminate your access to the Services (including any account) at any time, with or without notice, if we determine, in our sole discretion, that:

  • you have violated these Terms or applicable law;
  • your access or conduct poses a security risk;
  • your use exceeds authorized access or permissions;
  • your conduct may expose FWTI, users, partners, or third parties to legal or operational risk; or
  • it is otherwise necessary to protect the integrity of the Services.

9.3 Effect of Termination

Upon termination or suspension:

  • your right to access or use the Services will immediately cease;
  • FWTI may remove or restrict access to User‑Generated Content as permitted by law and consistent with the Services' functionality; and
  • any provisions of these Terms that by their nature should survive will survive (including Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification).

10. Governing Law and Venue

These Terms are governed by the laws of the State of Alabama, without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Services that is not subject to an alternative dispute resolution process (if applicable) shall be brought exclusively in the state or federal courts located in Montgomery County, Alabama, and you consent to the personal jurisdiction and venue of those courts.

11. Dispute Resolution

11.1 Informal Resolution First

Before filing a formal claim, you agree to first contact FWTI to attempt to resolve the dispute informally by emailing info@forestryworks.com with a brief description of your concern. We will make reasonable efforts to respond.

11.2 No Requirement to Continue Using the Services

Nothing in this section requires you to continue using the Services while a dispute is pending.

12. Notices

FWTI may provide notices to you by:

  • posting them on the Services,
  • sending them to an email address associated with your account (if applicable), or
  • other reasonable methods consistent with applicable law.

You are responsible for keeping your contact information current if you maintain an account.

13. Changes to These Terms

FWTI may update these Terms from time to time to reflect changes in our programs, Services, or legal requirements. When we make changes, we will update the effective date and post the revised Terms on the Services.

Your continued use of the Services after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Services.

14. Entire Agreement; Severability; Waiver

14.1 Entire Agreement

These Terms, together with any policies incorporated by reference (including the Privacy Policy) and any applicable program‑specific terms provided to you, constitute the entire agreement between you and FWTI regarding your use of the Services and supersede any prior or contemporaneous communications.

14.2 Severability

If any provision of these Terms is found unlawful, void, or unenforceable, the remaining provisions will remain in full force and effect.

14.3 No Waiver

FWTI's failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision.

15. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without FWTI's prior written consent. FWTI may assign these Terms as part of a merger, reorganization, program transfer, or other lawful business transaction.
